By accessing this website, mobile application, WhatsApp booking system, telephone booking, email booking, physical booking, digital platform, or by accepting the vehicle keys, OTP verification, digital signature, or electronic confirmation, you acknowledge that you have:

  • Read these Terms & Conditions.
  • Understood these Terms & Conditions.
  • Accepted these Terms & Conditions.
  • Agreed to be legally bound by these Terms & Conditions.

These Terms constitute a legally binding agreement between:

UNNATTI CAR RENTAL, a Unit of UNNATTI GLOBAL SERVICES PRIVATE LIMITED (“Company”, “We”, “Us”, “Our”),

and

The Customer, Driver, Guest, User, Corporate Client, Authorized Driver, Additional Driver, or any person using the vehicle (“Customer”, “You”, “Your”).

These Terms govern every booking, rental, extension, renewal, payment, cancellation, vehicle usage, return, dispute, and any other services provided by UNNATTI CAR RENTAL.

The Company reserves the right to modify, amend, replace, suspend, or update these Terms & Conditions at any time without prior notice. Updated Terms shall become effective immediately upon publication on the Company’s official website or application.

It is the Customer’s responsibility to review the latest Terms before every booking.

Definitions & Interpretation


1. DEFINITIONS

For the purpose of these Terms & Conditions, unless the context otherwise requires, the following expressions shall have the meanings assigned to them below:

1.1 Company

“Company” means UNNATTI CAR RENTAL, a business unit of UNNATTI GLOBAL SERVICES PRIVATE LIMITED, its directors, shareholders, officers, employees, representatives, franchisees, authorised agents, successors, assigns, affiliates, and authorised service providers.

1.2 Vehicle Owner

“Vehicle Owner” means the registered owner of the vehicle, whether an individual, partnership, company, financial institution, fleet owner, or any person who has lawfully authorised UNNATTI CAR RENTAL to rent or manage the vehicle.

1.3 Customer

“Customer”, “Guest”, “Renter”, “Driver”, or “User” means any person who:

  • Books or reserves a vehicle;
  • Drives or possesses the vehicle;
  • Is added as an authorised driver;
  • Receives possession of the vehicle;
  • Uses any service provided by the Company.

The Customer remains fully responsible for all obligations under these Terms, whether or not another authorised driver also uses the vehicle.

1.4 Booking

“Booking” means any reservation made through the Company’s website, mobile application, WhatsApp, telephone, email, social media, authorised agent, franchise, or physical office.

1.5 Rental Period

“Rental Period” means the period beginning from the official handover of the vehicle until the vehicle is returned, inspected, and formally accepted by the Company or Vehicle Owner.

1.6 Vehicle

“Vehicle” includes:

  • Cars;
  • SUVs;
  • MUVs;
  • Luxury vehicles;
  • Electric vehicles;
  • Accessories;
  • Keys;
  • FASTag;
  • RC Book;
  • Insurance papers;
  • GPS devices;
  • Dash cameras;
  • Tool kits;
  • Spare wheel;
  • Jack;
  • Safety equipment;
  • Any other item supplied with the vehicle.

1.7 Security Deposit

“Security Deposit” means the refundable amount, vehicle security, or any other security accepted by the Company against possible damages, penalties, unpaid charges, contractual breaches, or other liabilities.

The Company may accept:

  • Cash;
  • Bank transfer;
  • UPI;
  • Credit/Debit Card hold;
  • A two-wheeler as security (subject to Company approval);
  • Any other form of security approved by the Company.

Acceptance of any security does not limit the Customer’s liability if the actual loss exceeds the security amount.

1.8 Authorised Driver

An “Authorised Driver” means a person who:

  • Has been approved by the Company;
  • Holds a valid driving licence;
  • Has completed the required KYC verification; and
  • Has been expressly authorised to drive the vehicle.

Any unauthorised driver shall be treated as a material breach of this Agreement.

1.9 Prohibited Use

“Prohibited Use” includes, but is not limited to:

  • Driving under the influence of alcohol or drugs;
  • Racing or speed testing;
  • Off-road driving;
  • Carrying prohibited goods;
  • Criminal activities;
  • Commercial use without approval;
  • Sub-renting or transferring possession;
  • Tampering with GPS or vehicle systems;
  • Any use prohibited by applicable law or these Terms.

1.10 Digital Acceptance

Acceptance of these Terms may be evidenced by:

  • OTP verification;
  • Electronic signature;
  • Digital signature;
  • Website checkbox;
  • Mobile application acceptance;
  • WhatsApp confirmation;
  • Email confirmation;
  • Online payment;
  • Vehicle handover;
  • Acceptance of vehicle keys.

Such acceptance shall constitute valid electronic consent under applicable Indian law.


2. INTERPRETATION

These Terms shall be interpreted fairly to give effect to the lawful intentions of the parties. Headings are for convenience only and do not affect interpretation. If any provision is held invalid or unenforceable by a competent court, the remaining provisions shall continue in full force and effect to the maximum extent permitted by law.

Eligibility, Registration, KYC & Booking Approval


3. ELIGIBILITY TO USE THE SERVICES

To rent or use any vehicle from UNNATTI CAR RENTAL, every Customer must satisfy the eligibility requirements prescribed by the Company and applicable laws.

The Company reserves the absolute right to accept or reject any booking, registration, or Customer at its sole discretion without assigning any reason.

Acceptance of previous bookings shall not create any obligation upon the Company to accept future bookings.


4. CUSTOMER ELIGIBILITY

Every Customer must:

  • Be at least 20 years of age (or such higher age as prescribed by the Company for specific vehicle categories).
  • Hold a valid Driving Licence issued by the appropriate licensing authority (Minimum 6 Months Old).
  • Carry original Government-issued identity proof.
  • Successfully complete the Company’s Know Your Customer (KYC) verification process.
  • Provide true, complete, and accurate information.
  • Be legally competent to enter into a binding contract under applicable Indian law.
  • Not be prohibited by any law, court order, or regulatory authority from driving a motor vehicle.

The Company may prescribe additional eligibility conditions for premium, luxury, electric, or high-value vehicles.


5. KYC VERIFICATION

Before every booking, the Customer shall provide such documents and information as the Company may require, including but not limited to:

  • Aadhaar Card
  • Driving Licence
  • Passport (where applicable)
  • PAN Card (where required)
  • Passport-size photograph or selfie
  • Current residential address proof
  • Mobile number
  • Email address
  • Emergency contact details
  • Any additional document required by the Company or applicable law.

The Company may also require:

  • Live selfie verification
  • Video verification
  • Face matching
  • OTP authentication
  • Digital signature
  • Biometric verification where legally permitted.

Failure to complete KYC verification may result in cancellation or refusal of the booking without liability on the part of the Company.


6. VERIFICATION OF INFORMATION

The Customer authorises the Company to verify the information and documents submitted through:

  • Government databases;
  • Licensing authorities;
  • Vehicle registration authorities;
  • Credit verification agencies (where applicable);
  • Third-party KYC service providers;
  • Fraud prevention agencies; or
  • Any lawful source.

The Customer represents and warrants that all documents submitted are genuine, valid, and belong to the Customer.

Submission of forged, altered, false, expired, or misleading documents shall constitute a material breach of these Terms and may result in immediate cancellation of the booking, forfeiture of payments, blacklisting, and reporting to the appropriate authorities.


7.1 BOOKING ACCEPTANCE

A booking request shall not be deemed accepted merely because a request has been submitted or payment has been initiated.

A booking shall be confirmed only after:

  • Successful KYC verification;
  • Driving Licence verification;
  • Payment verification;
  • Vehicle availability confirmation;
  • Acceptance by the Company.

The Company reserves the right to refuse, suspend, cancel, or modify any booking if:

  • Required documents are incomplete or invalid;
  • Fraud or misrepresentation is suspected;
  • The Customer fails eligibility requirements;
  • Operational, safety, legal, or regulatory reasons arise; or
  • Any other reasonable business ground exists.

7.2 Driving License Eligibility & Advance Payment Policy

The renter must possess a valid Indian Driving License that has been issued for a minimum period of 6 (six) months prior to the date of booking.

Unnatti Car Rental reserves the right to decline bookings made using Driving Licenses issued by certain restricted jurisdictions, including licenses issued from any of the 8 Union Territories of India such as ( Andaman and Nicobar Islands , Chandigarh , Dadra and Nagar Haveli and Daman and Diu , Delhi (National Capital Territory of Delhi) , Jammu and Kashmir , Ladakh , Lakshadweep , Puducherry ), in accordance with the Company’s internal risk assessment and verification policies.

If, at any stage before or during the rental, it is found that the customer does not satisfy the above eligibility requirements, including but not limited to holding a Driving License issued for less than 6 (six) months or a Driving License issued from a restricted jurisdiction, the booking shall be cancelled immediately.

Any advance amount paid at the time of booking is strictly non-refundable, as it is immediately utilized towards booking confirmation, document verification, identity verification, compliance checks, administrative processing, reservation blocking, and other service-related charges incurred by the Company. Since these services are initiated upon receipt of the advance payment, no refund, whether full or partial, shall be issued under any circumstances arising from the customer’s failure to meet the Company’s eligibility requirements or booking conditions.

It is the sole responsibility of the customer to ensure that all eligibility requirements are fulfilled before making a reservation with Unnatti Car Rental.


IMPORTANT CUSTOMER DECLARATION

The Customer declares and confirms that all information, declarations, documents, photographs, signatures, and digital consents provided to UNNATTI CAR RENTAL are true, correct, and complete. The Customer further acknowledges that any false declaration, concealment of material facts, impersonation, or use of forged documents may result in cancellation of the booking, forfeiture of applicable charges, legal proceedings, and reporting to law enforcement authorities.

Booking Process, Payments & Security Deposit


8. BOOKING PROCESS

A booking may be made through:

  • Official Website
  • Mobile Application
  • WhatsApp
  • Telephone
  • Email
  • Company Office
  • Authorised Agent
  • Corporate Booking
  • Any other booking channel officially approved by UNNATTI CAR RENTAL.

A booking shall be considered confirmed only after:

  • Successful KYC verification;
  • Verification of the Driving Licence;
  • Confirmation of vehicle availability;
  • Acceptance by the Company; and
  • Receipt of the required booking amount and/or security deposit, if applicable.

The Company reserves the right to refuse, suspend, modify, or cancel any booking at its sole discretion for operational, legal, safety, fraud-prevention, or compliance reasons.


9. RENTAL CHARGES

The Customer agrees to pay all applicable charges, including but not limited to:

  • Rental Charges;
  • Booking Charges;
  • Security Deposit;
  • GST and other applicable taxes;
  • FASTag charges;
  • Toll charges;
  • Parking charges;
  • Fuel charges (where applicable);
  • Extra kilometre charges;
  • Late return charges;
  • Cleaning charges;
  • Damage charges;
  • Recovery charges;
  • Penalties;
  • Legal recovery expenses (where legally recoverable);
  • Any other charges notified by the Company.

All applicable charges shall be payable immediately upon demand by the Company.


10. SECURITY DEPOSIT

To safeguard the Company’s and Vehicle Owner’s interests, every booking may require a refundable Security Deposit.

The standard Security Deposit shall generally be:

Premium Sedan / Compact SUV   ₹5,000 – ₹10,000
SUV / Luxury / Premium Vehicles   ₹10,000 – ₹15,000

The Company may increase, reduce, waive, or modify the Security Deposit requirement at its sole discretion.


11. ALTERNATIVE SECURITY

Where the Customer is unable to provide the prescribed Security Deposit, the Company may, at its sole discretion, accept an alternative form of security.

Such security may include:

  • A Two-Wheeler;
  • Any other movable property acceptable to the Company; or
  • Any other security approved by the Company.

Acceptance of alternative security shall be entirely at the Company’s discretion and shall not create any obligation to accept such security in future bookings.

The Company shall have the right to retain such security until:

  • The vehicle is returned;
  • The inspection is completed;
  • All outstanding dues are cleared;
  • No accident, damage, theft, challan, legal claim, or contractual breach remains pending.

If the Customer fails to discharge outstanding liabilities, the Company may exercise its contractual and legal remedies, including retaining the security until the dispute is resolved, subject to applicable law.


12. SECURITY DEPOSIT ADJUSTMENT

The Company may adjust or deduct the Security Deposit, wholly or partly, against:

  • Vehicle damage;
  • Missing accessories;
  • Fuel shortage;
  • FASTag dues;
  • Toll charges;
  • Traffic challans;
  • Parking penalties;
  • Late return charges;
  • Excess kilometre charges;
  • Cleaning charges;
  • Recovery expenses;
  • Legal expenses (where legally recoverable);
  • Outstanding rental charges;
  • Breach of these Terms & Conditions; or
  • Any other lawful amount payable by the Customer.

If the Security Deposit is insufficient, the Customer shall remain liable to pay the balance immediately upon demand.


13. REFUND OF SECURITY DEPOSIT

Subject to successful completion of post-trip inspection and verification, the Security Deposit (after permissible deductions) shall ordinarily be refunded within the period specified in the Company’s Security Deposit Policy.

The Company may defer the refund where:

  • An accident investigation is pending;
  • Insurance verification is pending;
  • Traffic challans have not yet been received;
  • Damage assessment is pending;
  • Police or court proceedings are pending;
  • There is any unresolved contractual or legal issue arising from the booking.

IMPORTANT NOTICE

The Security Deposit is only a temporary financial safeguard. It does not limit or cap the Customer’s liability. If the actual loss, damage, legal liability, recovery expense, or other payable amount exceeds the Security Deposit, the Customer shall remain fully responsible for paying the entire balance in accordance with these Terms and applicable law.

Vehicle Handover, Inspection & Customer Acceptance


14. VEHICLE HANDOVER

The Company shall hand over the Vehicle to the Customer only after:

  • Successful KYC verification.
  • Verification of the original Driving Licence.
  • Completion of payment formalities.
  • Receipt of the Security Deposit or other approved security.
  • Acceptance of these Terms & Conditions.
  • Completion of the Vehicle Inspection Checklist.

The Company reserves the right to refuse handover if any verification remains incomplete or if it reasonably believes that handing over the vehicle may expose the Company, the Vehicle Owner, or the public to unacceptable risk.


15. VEHICLE INSPECTION BEFORE HANDOVER

Before taking possession of the Vehicle, the Customer must personally inspect the Vehicle and verify its condition.

The inspection shall include, but is not limited to:

  • Exterior body panels
  • Front and rear bumpers
  • Bonnet and boot
  • Roof
  • Windscreen
  • Windows and mirrors
  • Headlights and tail lamps
  • Indicators
  • Tyres and alloy wheels
  • Spare wheel
  • Interior condition
  • Seats and upholstery
  • Dashboard
  • Infotainment system
  • Air conditioning
  • Fuel level
  • Odometer reading
  • Vehicle documents
  • FASTag
  • Vehicle keys
  • Tool kit
  • Jack
  • Safety equipment
  • First-aid kit (where available)
  • Fire extinguisher (where available)

Any visible damage or discrepancy shall be recorded before the trip begins.


16. PHOTOGRAPHS, VIDEOS & DIGITAL RECORDS

To maintain transparency and protect all parties, the Company may capture or require the Customer to capture:

  • 360-degree photographs of the Vehicle;
  • Interior photographs;
  • Odometer photographs;
  • Fuel gauge photographs;
  • Video recordings;
  • Selfie with the Vehicle;
  • GPS location;
  • Date and time stamp;
  • Digital inspection checklist.

These digital records shall form part of the official booking record and may be relied upon for dispute resolution, insurance claims, recovery proceedings, or legal processes, subject to applicable law.


17. CUSTOMER ACCEPTANCE OF VEHICLE CONDITION

By accepting possession of the Vehicle, starting the trip, entering the Vehicle, taking the keys, or confirming the inspection through OTP, digital signature, mobile application, WhatsApp, email, or any electronic means, the Customer acknowledges and confirms that:

  • The Vehicle has been inspected by the Customer.
  • The Vehicle appeared roadworthy based on the Customer’s inspection at handover.
  • The Customer has received the Vehicle in acceptable condition, except for defects or damages specifically recorded before departure.
  • The Customer has had a reasonable opportunity to inspect the Vehicle and raise concerns before taking possession.
  • The Customer is satisfied with the condition of the Vehicle for the intended journey.

The Customer shall promptly report any defect noticed before commencing the trip. Failure to do so may result in the condition recorded at handover being treated as accepted by the Customer.


18. CUSTOMER RESPONSIBILITY AFTER HANDOVER

From the time the Vehicle is handed over until it is returned and formally accepted back by the Company, the Customer shall:

  • Exercise reasonable care in using the Vehicle.
  • Comply with all applicable traffic laws.
  • Prevent misuse or unauthorised use.
  • Keep the Vehicle secure.
  • Safeguard the keys and documents.
  • Immediately report any accident, theft, breakdown, seizure, or other incident to the Company.

The Customer remains responsible for the Vehicle during the Rental Period in accordance with these Terms and applicable law.


IMPORTANT LEGAL NOTICE

The Company’s inspection, photographs, videos, or handover process are intended to document the condition of the Vehicle at the time of delivery. They do not constitute a guarantee that the Vehicle will remain free from mechanical failure, nor do they relieve the Company or Customer of any responsibilities imposed by applicable law. If the Customer notices any safety-related issue before or during the trip, the Customer must stop using the Vehicle where reasonably safe to do so and notify the Company immediately.

Vehicle Usage Policy (Permitted & Prohibited Use)


19. PERMITTED USE OF THE VEHICLE

The Vehicle shall be used only for lawful personal transportation and strictly in accordance with:

  • These Terms & Conditions;
  • The Booking Confirmation;
  • Applicable laws of India;
  • Directions issued by Unnatti Car Rental from time to time.

The Vehicle may only be driven by:

  • the Primary Customer; and
  • any additional driver expressly approved by Unnatti Car Rental after successful KYC and Driving Licence verification.

No other person shall be permitted to drive the Vehicle.


20. PROHIBITED USE

The following uses of the Vehicle are strictly prohibited. Any breach may result in immediate termination of the booking, repossession of the Vehicle, forfeiture of deposits, additional charges, suspension of the Customer’s account, and legal action.

The Vehicle shall NOT be used for:

  • Driving under the influence of alcohol, drugs, or intoxicating substances.
  • Driving without a valid Driving Licence.
  • Allowing any unverified or unauthorized person to drive.
  • Street racing, drag racing, drifting, stunts, burnouts, or speed testing.
  • Transporting explosives, firearms, hazardous chemicals, or illegal goods.
  • Smuggling or any criminal activity.
  • Carrying narcotic drugs or prohibited substances.
  • Human trafficking or transporting illegal passengers.
  • Terrorist or unlawful activities.
  • Political rallies without prior written approval.
  • Commercial taxi operations.
  • Ride-hailing services including Uber, Ola, Rapido, BluSmart, InDrive, or similar services unless specifically authorized.
  • Driving schools or driver training.
  • Towing another vehicle without written permission.
  • Off-road driving unless specifically permitted.
  • Driving through flooded roads, rivers, beaches, deserts, forest tracks, or restricted areas.
  • Motor sports events.
  • Reckless or dangerous driving.
  • Purposely damaging the Vehicle.
  • Tampering with GPS, telematics, speed limiter, or tracking devices.
  • Disconnecting any Company-installed device.
  • Carrying goods exceeding permitted limits.
  • Carrying hazardous cargo.
  • Illegal mining or transportation.
  • Wildlife offences.
  • Customs violations.
  • Transporting stolen property.
  • Using false number plates.
  • Altering the Vehicle’s appearance.
  • Removing Company branding or stickers.
  • Using the Vehicle after expiry of the Booking Period without approval.
  • Any activity prohibited under Indian law.

21. ALCOHOL, DRUGS & INTOXICATION

The Customer shall never drive the Vehicle:

  • after consuming alcohol;
  • after consuming narcotic drugs;
  • under the influence of prescription medicines affecting driving ability;
  • while impaired by any intoxicating substance.

If the Customer is found driving under the influence:

  • the booking shall immediately stand terminated;
  • all protection plans shall become void to the extent permitted by law;
  • the Customer shall bear full responsibility for resulting losses, damages, penalties, or liabilities, subject to applicable law;
  • the Company may recover all expenses incurred due to such conduct.

22. OVERSPEEDING

The Customer shall comply with all applicable speed limits.

Repeated overspeeding may result in:

  • warning notifications;
  • monetary penalties;
  • booking suspension;
  • permanent account suspension;
  • recovery of additional losses where applicable.

Vehicle telemetry, GPS data, speed records, FASTag data, toll records, and other electronic evidence may be relied upon for verification.


23. UNAUTHORIZED DRIVERS

The Vehicle shall not be driven by any person who:

  • has not completed KYC;
  • has not been approved by Unnatti Car Rental;
  • does not possess a valid Driving Licence;
  • is below the legal driving age;
  • is intoxicated or otherwise legally disqualified from driving.

The Customer remains responsible for any use of the Vehicle by an unauthorized driver to the extent permitted by law.


24. GEOGRAPHICAL RESTRICTIONS

The Vehicle may only be driven:

  • within India;
  • in locations permitted by Unnatti Car Rental;
  • in accordance with the booking terms.

The Vehicle shall not be taken:

  • outside India;
  • into prohibited military areas;
  • into restricted border areas without required permissions;
  • into regions where travel is prohibited by Government authorities or where the Company has notified restrictions.

25. VEHICLE CARE

The Customer shall:

  • maintain reasonable cleanliness;
  • use appropriate fuel;
  • monitor engine warning indicators;
  • check tyre condition during long trips where reasonably practicable;
  • avoid negligent operation of the Vehicle.

The Customer shall not:

  • smoke inside the Vehicle if prohibited by Company policy;
  • damage interiors;
  • remove accessories;
  • modify the Vehicle;
  • install electrical equipment without written approval.

26. PET POLICY

Pets may only be carried if permitted under the booking terms.

The Customer shall remain responsible for:

  • cleaning costs;
  • upholstery damage;
  • odour removal;
  • scratches;
  • hair removal charges;
  • any additional restoration expenses reasonably incurred.

27. RESPONSIBILITY FOR TRAFFIC VIOLATIONS

The Customer shall be solely responsible for:

  • traffic challans;
  • parking violations;
  • toll violations;
  • FASTag dues;
  • towing charges;
  • impounding charges;
  • congestion charges;
  • municipal penalties;
  • any fines arising during the Rental Period.

Where the Company or Vehicle Owner is required to pay such amounts first, the Customer authorizes the Company to recover the applicable amount along with reasonable administrative charges were permitted by law.


28. ZERO-TOLERANCE POLICY

Unnatti Car Rental maintains a zero-tolerance policy towards:

  • drunk driving;
  • drug-impaired driving;
  • dangerous driving;
  • criminal misuse of Vehicles;
  • abuse of staff;
  • threats;
  • fraud;
  • identity theft;
  • document forgery;
  • payment fraud;
  • GPS tampering;
  • odometer tampering;
  • theft or attempted theft of the Vehicle.

Any such conduct may result in immediate booking termination, permanent suspension from the platform, reporting to law enforcement authorities, and legal proceedings in accordance with applicable law.

Accidents, Theft, Insurance, Third-Party Liability & Customer Responsibility

29. ACCIDENT REPORTING

In the event of any accident, collision, fire, theft, natural disaster, vandalism, or any incident involving the Vehicle, the Customer must:

  • Immediately stop the Vehicle at a safe location.
  • Ensure the safety of all occupants.
  • Inform local police wherever required by law.
  • Call emergency medical services if any person is injured.
  • Inform Unnatti Car Rental immediately and in any event within 30 minutes of the incident.
  • Share the exact GPS location.
  • Provide photographs and videos of:
    • the Vehicle;
    • the accident scene;
    • surrounding area;
    • registration numbers of all involved vehicles;
    • visible damages;
    • road conditions.
  • Cooperate fully with the Company, Vehicle Owner, insurer, surveyor, police, or any investigating authority.

Failure to comply may affect any protection plans or assistance available under these Terms, subject to applicable law and insurance requirements.


30. POLICE REPORT (FIR)

The Customer shall promptly lodge an FIR or other legally required police report where applicable, including in cases involving:

  • theft;
  • attempted theft;
  • major accident;
  • third-party injury;
  • death;
  • vehicle fire;
  • criminal acts;
  • vandalism;
  • hit-and-run incidents;
  • vehicle disappearance.

A copy of the FIR and all related documents shall be shared with Unnatti Car Rental without delay.


31. DUTY TO COOPERATE

The Customer agrees to provide full cooperation during:

  • insurance investigations;
  • police investigations;
  • court proceedings;
  • arbitration;
  • recovery actions;
  • claims administration.

This includes attending hearings if legally required and providing truthful information and supporting documents.


32. VEHICLE DAMAGE

The Customer shall exercise reasonable care to protect the Vehicle throughout the Rental Period.

The Customer may be held responsible, to the extent permitted by law and subject to any applicable protection plan or insurance, for damage resulting from:

  • negligent driving;
  • reckless driving;
  • intentional acts;
  • unauthorized use;
  • prohibited use under these Terms;
  • violation of traffic laws;
  • failure to report an accident promptly;
  • allowing an unauthorized driver to operate the Vehicle.

Damage may include, without limitation:

  • body damage;
  • engine damage;
  • transmission damage;
  • suspension damage;
  • tyre and wheel damage;
  • glass breakage;
  • interior damage;
  • electrical damage;
  • water ingress;
  • fire damage;
  • flood damage;
  • accessory damage;
  • GPS or telematics damage.

33. TOTAL LOSS

A Vehicle may be considered a Total Loss if:

  • declared a total loss by the insurer;
  • repair costs exceed the insured value or commercially reasonable repair limits;
  • permanently destroyed;
  • burnt;
  • irrecoverably damaged;
  • declared beyond economical repair.

In such cases, liability shall be determined in accordance with the applicable insurance policy, protection plan, and Indian law.


34. VEHICLE THEFT

If the Vehicle is stolen or suspected to be stolen, the Customer shall immediately:

  • inform the nearest police station;
  • register an FIR;
  • notify Unnatti Car Rental;
  • surrender all keys;
  • provide all available documents and information.

Failure to promptly report theft or cooperate with recovery efforts may affect available protections under these Terms.


35. THIRD-PARTY CLAIMS

If any third-party files a claim arising from the use of the Vehicle during the Rental Period, the Customer shall:

  • immediately notify Unnatti Car Rental;
  • cooperate in defending the claim;
  • provide all requested documents;
  • attend proceedings where legally required.

The Company will coordinate with the Vehicle Owner and insurer as appropriate.


36. INSURANCE

Each listed Vehicle must maintain valid insurance as required by applicable law.

Insurance coverage remains subject to:

  • policy terms;
  • exclusions;
  • deductibles;
  • insurer approval;
  • applicable law.

Unnatti Car Rental is not an insurance company and does not independently insure the Vehicle unless expressly stated in writing.


37. INSURANCE CLAIM REJECTION

If an insurance claim is rejected because of the Customer’s actions or omissions, including but not limited to:

  • drunk driving;
  • drug-impaired driving;
  • unauthorized driver;
  • fake documents;
  • intentional damage;
  • criminal activity;
  • breach of policy conditions;
  • delayed reporting;
  • false statements;
  • absconding from the accident scene;
  • any other violation attributable to the Customer,

the Customer shall remain responsible for losses, damages, liabilities, penalties, and costs to the extent permitted by law.


38. THIRD-PARTY LIABILITY

Where a third-party claim arises due to the Customer’s negligent or unlawful use of the Vehicle, the Customer agrees to cooperate with the Vehicle Owner, insurer, and Unnatti Car Rental in resolving the matter.

Nothing in these Terms excludes any statutory rights or liabilities under the Motor Vehicles Act, 1988 or other applicable laws.


39. RECOVERY OF LOSSES

Where permitted by law, Unnatti Car Rental may recover from the Customer any amounts reasonably incurred due to the Customer’s breach of these Terms, including:

  • repair costs;
  • towing charges;
  • parking charges;
  • storage charges;
  • legal expenses (where recoverable);
  • investigation costs;
  • administrative costs;
  • recovery expenses;
  • unpaid tolls;
  • FASTag dues;
  • traffic penalties paid on the Customer’s behalf;
  • loss of income resulting from Vehicle downtime, where contractually applicable and legally enforceable.

40. VEHICLE OWNER PROTECTION

Unnatti Car Rental acts as a technology platform connecting Vehicle Owners and Customers.

The Company will make commercially reasonable efforts to assist Vehicle Owners with:

  • accident reporting;
  • claim documentation;
  • customer communication;
  • recovery coordination;
  • insurance support;
  • legal documentation where appropriate.

However, the Company does not guarantee recovery of losses from Customers, insurers, or third parties.


41. COMPANY LIABILITY

To the maximum extent permitted by applicable law, Unnatti Car Rental shall not be liable for:

  • acts or omissions of Customers;
  • acts or omissions of Vehicle Owners;
  • third-party negligence;
  • insurer decisions;
  • police actions;
  • court orders;
  • road conditions;
  • mechanical failures not caused by the Company;
  • force majeure events;
  • indirect or consequential losses.

Nothing in these Terms limits liability where such limitation is prohibited under applicable law.


42. CUSTOMER ACKNOWLEDGEMENT

By commencing the Rental Period, the Customer acknowledges that they:

  • have inspected the Vehicle;
  • found it fit for use (except as recorded at handover);
  • understand their legal responsibilities;
  • agree to comply with these Terms;
  • will immediately report any accident, damage, or theft;
  • will cooperate fully with Unnatti Car Rental, the Vehicle Owner, insurers, and authorities.

Payments, Security Deposit, Penalties, Indemnity & Limitation of Liability

43. BOOKING CHARGES

The Customer agrees to pay all applicable charges displayed at the time of booking, including but not limited to:

  • Rental Charges;
  • Platform/Convenience Fee;
  • Security Deposit (if applicable);
  • Home Delivery Charges (if selected);
  • Extension Charges;
  • Late Return Charges;
  • FASTag and Toll Charges;
  • Parking Charges;
  • Fuel Adjustment Charges (if applicable);
  • Damage Charges (subject to these Terms and applicable law);
  • Applicable Taxes (GST or other statutory taxes).

All prices are displayed in Indian Rupees (INR) unless otherwise stated.


44. SECURITY DEPOSIT

Unnatti Car Rental may require a refundable Security Deposit before the booking begins.

The deposit may be used, where applicable, to recover:

  • unpaid rental charges;
  • tolls and FASTag deductions;
  • parking fees;
  • traffic challans;
  • fuel shortages;
  • excessive cleaning charges;
  • smoking or interior restoration costs where prohibited;
  • missing accessories;
  • document replacement costs;
  • key replacement costs;
  • late return charges;
  • any other contractually due amount.

Any balance remaining after lawful deductions will be refunded within the applicable processing period.


45. PAYMENT AUTHORIZATION

By making a booking, the Customer authorizes Unnatti Car Rental to:

  • collect booking charges;
  • block or debit the Security Deposit;
  • process refunds;
  • recover unpaid dues;
  • charge additional authorized amounts arising under these Terms.

Payments may be processed through authorized payment gateways or banking partners.


46. PAYMENT FAILURE

If any payment fails due to:

  • insufficient balance;
  • card decline;
  • UPI failure;
  • chargeback;
  • payment reversal;
  • expired payment method; or
  • any reason attributable to the Customer,

the Company may:

  • suspend the booking;
  • cancel the booking;
  • recover outstanding dues through lawful means;
  • suspend or terminate the Customer’s account until payment is received.

47. LATE RETURN CHARGES

The Vehicle must be returned on or before the scheduled return time.

If the Customer returns the Vehicle late without prior approval, additional charges may apply based on the Company’s Fee Policy, including:

  • additional rental charges;
  • late return fees;
  • compensation for disruption to subsequent bookings, where contractually applicable.

If the Vehicle is not returned within a reasonable time and the Customer cannot be contacted, the Company or Vehicle Owner may notify law enforcement where appropriate.


48. CANCELLATION & REFUNDS

Cancellation charges shall be governed by the applicable Cancellation Policy in effect at the time of booking.

Eligible refunds, if any, will generally be processed to the original payment method within the stated processing timeline, subject to banking delays and verification requirements.


49. CHARGEBACKS & PAYMENT DISPUTES

The Customer shall not initiate a chargeback or payment reversal for valid charges due under these Terms.

Where a chargeback is found to be fraudulent or unjustified, Unnatti Car Rental may:

  • recover the disputed amount through lawful means;
  • suspend the Customer’s account;
  • deny future bookings;
  • initiate appropriate legal proceedings where warranted.

50. FRAUD PREVENTION

The Company reserves the right to investigate suspected fraud, including:

  • identity fraud;
  • forged documents;
  • fake KYC;
  • stolen payment instruments;
  • account misuse;
  • multiple fake accounts;
  • manipulated GPS data;
  • odometer tampering;
  • payment fraud;
  • booking abuse.

The Company may cooperate with law enforcement agencies and financial institutions in such investigations.


51. ACCOUNT SUSPENSION OR TERMINATION

Unnatti Car Rental may suspend or terminate a customer or Vehicle Owner account for reasons including, but not limited to:

  • breach of these Terms;
  • fraudulent activity;
  • criminal conduct;
  • repeated payment defaults;
  • abuse of staff;
  • misuse of Vehicles;
  • repeated cancellations or no-shows (where applicable);
  • submission of false information;
  • non-compliance with applicable laws.

Where feasible, notice will be provided unless immediate suspension is necessary to protect users, the Company, or comply with legal obligations.


52. RIGHT OF RECOVERY

Where permitted by law, the Company may recover unpaid amounts through lawful means, including:

  • Security Deposit adjustment;
  • future booking adjustments;
  • voluntary payment requests;
  • legal recovery proceedings.

No recovery action shall exceed amounts lawfully due.


53. CUSTOMER INDEMNITY

To the extent permitted by law, the Customer agrees to indemnify and hold harmless Unnatti Car Rental, the Vehicle Owner, its directors, employees, officers, representatives, and affiliates from claims, losses, costs, or damages arising directly from:

  • breach of these Terms;
  • negligent or unlawful use of the Vehicle;
  • submission of false information;
  • violation of applicable laws;
  • infringement of third-party rights;
  • misuse of the Platform.

This indemnity does not apply to losses caused by the Company’s own negligence or wilful misconduct.


54. VEHICLE OWNER INDEMNITY

Vehicle Owners agree to indemnify Unnatti Car Rental against claims arising from:

  • false ownership claims;
  • invalid or expired documents;
  • failure to maintain legally required insurance;
  • concealment of known vehicle defects;
  • non-compliance with applicable laws.

This clause is subject to applicable legal limitations.


55. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Unnatti Car Rental shall not be liable for:

  • indirect or consequential losses;
  • loss of profits;
  • business interruption;
  • loss of opportunity;
  • emotional distress;
  • losses caused by third parties;
  • acts of Customers or Vehicle Owners;
  • insurer decisions;
  • governmental actions;
  • road conditions;
  • force majeure events.

Nothing in these Terms excludes liability that cannot legally be excluded.


56. MAXIMUM LIABILITY

Except where prohibited by law, the aggregate liability of Unnatti Car Rental arising out of or relating to these Terms shall not exceed the total service fees actually received by the Company for the specific booking giving rise to the claim.

This limitation does not affect any non-excludable statutory rights of consumers.


57. SURVIVAL

The following provisions shall survive termination or completion of the booking, to the extent applicable:

  • payment obligations;
  • indemnity;
  • limitation of liability;
  • dispute resolution;
  • confidentiality;
  • data retention obligations;
  • intellectual property rights.

Dispute Resolution, Governing Law, Intellectual Property & General Legal Provisions

58. DISPUTE RESOLUTION

Unnatti Car Rental is committed to resolving disputes efficiently and fairly.

If any dispute arises relating to:

  • a booking;
  • payment;
  • vehicle condition;
  • accident;
  • damage;
  • insurance;
  • cancellation;
  • refunds;
  • platform usage; or
  • these Terms,

the parties agree to first attempt to resolve the matter through good-faith discussions with Unnatti Car Rental Customer Support.


59. COMPLAINT PROCESS

Customers and Vehicle Owners should submit complaints through:

  • the Unnatti Car Rental mobile application;
  • the official website;
  • the designated customer support email; or
  • any officially notified support channel.

The complaint should include, where applicable:

  • Booking ID;
  • Vehicle Number;
  • Date and time;
  • Description of the issue;
  • Supporting photographs, videos, or documents.

Failure to provide sufficient information may delay resolution.


60. MEDIATION

Where appropriate, Unnatti Car Rental may invite the parties to participate in a voluntary mediation process before commencing formal legal proceedings.

Participation in mediation does not affect any legal rights unless a settlement agreement is executed.


61. ARBITRATION

If a dispute cannot be resolved amicably, it shall, where legally enforceable, be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended.

  • The arbitration shall ordinarily be conducted by a sole independent arbitrator.
  • The seat and venue of arbitration shall ordinarily be Pune, Maharashtra, unless otherwise agreed by the parties or required by applicable law.
  • Proceedings shall be conducted in English.
  • The arbitral award shall be final and binding, subject to any rights available under applicable law.

Nothing in this clause prevents either party from approaching a competent court for urgent interim relief where permitted.


62. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Republic of India.


63. JURISDICTION

Subject to the arbitration clause and applicable consumer protection laws, the courts having jurisdiction over Pune, Maharshtra, shall have jurisdiction over disputes arising from these Terms.


64. INTELLECTUAL PROPERTY

All rights relating to:

  • the Unnatti Car Rental name;
  • logo;
  • branding;
  • software;
  • website;
  • mobile application;
  • designs;
  • content;
  • graphics;
  • source code;
  • databases;
  • documentation;
  • trademarks; and
  • business processes,

are owned by or licensed to Unnatti Car Rental.

No person may copy, reproduce, modify, distribute, reverse engineer, sell, or commercially exploit any part of the Platform without prior written permission.


65. USER CONTENT

If a Customer or Vehicle Owner uploads:

  • reviews;
  • photographs;
  • videos;
  • comments;
  • ratings; or
  • feedback,

they grant Unnatti Car Rental a non-exclusive, royalty-free, worldwide licence to use, reproduce, publish, and display such content for operating and promoting the Platform, subject to applicable privacy laws.

The user confirms that they have the necessary rights to submit such content.


66. FORCE MAJEURE

Unnatti Car Rental shall not be liable for delays or failures in performance caused by events beyond its reasonable control, including but not limited to:

  • natural disasters;
  • floods;
  • earthquakes;
  • fires;
  • pandemics;
  • epidemics;
  • war;
  • terrorism;
  • riots;
  • strikes;
  • government restrictions;
  • internet outages;
  • cyberattacks;
  • power failures; or
  • other unforeseen events.

Performance shall resume as soon as reasonably practicable after the event ends.


67. SEVERABILITY

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, the remaining provisions shall continue in full force and effect.


68. WAIVER

Failure by Unnatti Car Rental to enforce any provision of these Terms shall not constitute a waiver of that provision or of any other rights.

Any waiver must be made expressly in writing.


69. ASSIGNMENT

Customers and Vehicle Owners may not assign or transfer their rights or obligations under these Terms without prior written consent from Unnatti Car Rental.

Unnatti Car Rental may assign or transfer its rights and obligations to an affiliate, successor, or purchaser of its business, subject to applicable law.


70. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, Platform Terms of Use, Fee Policy, Vehicle Owner Agreement, and any other policies published by Unnatti Car Rental, constitute the entire agreement between the parties regarding the use of the Platform.

They supersede all prior oral or written understandings relating to the same subject matter.


71. AMENDMENTS

Unnatti Car Rental reserves the right to amend these Terms from time to time.

Material changes will be notified through the Platform, email, SMS, WhatsApp, or other appropriate communication channels.

Continued use of the Platform after such changes become effective constitutes acceptance of the updated Terms.


72. ELECTRONIC ACCEPTANCE

By:

  • creating an account;
  • clicking “I Agree”;
  • making a booking;
  • listing a vehicle;
  • using the Platform; or
  • otherwise accessing the services,

the Customer and Vehicle Owner acknowledge that they have:

  • read these Terms;
  • understood these Terms;
  • voluntarily accepted these Terms; and
  • agree to be legally bound by them.

Electronic acceptance shall have the same legal effect as a handwritten signature under applicable Indian law.

74. EFFECTIVE DATE

These Terms & Conditions shall become effective from the date published on the Unnatti Car Rental Platform and shall remain in force until replaced or amended.


CUSTOMER DECLARATION

By using the Platform, I confirm that:

  • I am at least 18 years of age and legally competent to contract.
  • I have read and understood these Terms & Conditions.
  • I agree to comply with all applicable laws and the policies of Unnatti Car Rental.
  • I understand my responsibilities as a Customer or Vehicle Owner.
  • I consent to electronic records and communications in accordance with applicable Indian law.
